What's actually happening.
The adjuster's number came back and it doesn't cover what happened. Maybe they denied the claim outright on an exclusion you didn't know existed. Maybe they totalled your car and valued it below anything comparable on the market. Maybe they cut the body shop's estimate, or decided the accident was your fault. The first offer is a starting position, and the file closes quietly if nobody pushes back.
What we draft.
I am writing to appeal the total-loss valuation issued March 14, 2026 on claim [CLAIM NUMBER] for my 2019 Honda Accord EX. Your valuation report sets the actual cash value at $14,320. I respectfully disagree. The report's three comparable vehicles are each 40,000 to 55,000 miles above my vehicle's documented 61,400 miles, and two are of a lower trim. Attached are four listings for 2019 Accord EX vehicles within 75 miles, comparably equipped, priced between $17,900 and $19,400...
Full letter includes: claim and policy identifiers, the specific decision under appeal, the factual and policy basis for the challenge, the appraisal-clause reference where valuation is in dispute, the remedy requested, and a signature block.

Laws we cite.
We ground every letter in real statutes and regulations. Here's what applies to your situation:
Your policy An auto claim is a contract dispute first — the policy's coverage, exclusions, and duties are the primary ground the appeal argues from.
Appraisal clause Most auto policies contain an appraisal provision for resolving a disagreement over the value of a loss. Where your policy has one, the letter references it.
NAIC Model Act #900 The Unfair Claims Settlement Practices Act most states model their insurance code on — regulators expect claims handled promptly and in good faith.
State Dept. of Insurance Every state has a regulator that takes consumer complaints about claim handling. The letter notes this escalation path descriptively.
Who this isn't for.
We're honest about our limits. FightThis may not be right if:
- Anyone was injured in the accident — an injury claim needs a personal-injury attorney, not a letter.
- You are in active litigation, arbitration, or appraisal with the carrier already.
- The dispute is with someone else's insurer over a third-party liability claim, rather than your own carrier under your own policy.
- The carrier alleges fraud or material misrepresentation on the application — that's serious enough to warrant a lawyer.
If your situation is high-stakes, please find a local attorney. Many state bars have free or low-cost referral services.
Common questions.
How long do I have to appeal?
It depends on your policy and your state — some policies set an internal deadline, and states set outer limits on when suit can be brought on the contract. Check your denial letter and policy for any stated deadline, and don't sit on it.
What is an appraisal clause?
Most auto policies include a provision that either side can invoke when they disagree on the amount of a loss: each picks an appraiser, the two pick an umpire, and their agreement sets the value. It applies to the amount of the loss, not to whether the claim is covered. Read your own policy to confirm it's there.
Is this the same as your insurance denial appeals?
No. That vertical handles health insurance denials under ERISA and ACA rules. This one handles auto claims, which are governed by your policy contract and state insurance regulation instead.
What should I upload?
The denial letter, claim decision, total-loss valuation report, or repair estimate you disagree with. Photos, independent estimates, and comparable vehicle listings all strengthen the appeal — include them with what you mail.
Will this force them to pay?
No letter can guarantee an outcome. What a documented, specific appeal does is put your position in the claim file in writing and require a considered response, rather than letting the first offer stand unchallenged.
What if they still refuse?
You can escalate a complaint to your state Department of Insurance, invoke the appraisal clause where the dispute is over value, or consult an attorney. The letter is the step that documents you disputed it.
